1. Terms & Conditions
1.1. The Hub Park Recreational Center Limited ("The Hub Park," "we," "us," "our"), located at The Hub Karen, Dagoretti Rd, Nairobi, Kenya, operates the family entertainment center and other adventure activities described on this website (collectively referred to as the "Activities"). These Terms & Conditions ("Terms") govern your use of our website and participation in our Activities.
1.2. By accessing our website or booking Activities, you agree to and accept these Terms. If you do not agree, you may not use our website or participate in the Activities.
2. Our Contract
2.1. The contract between you and The Hub Park is formed when you confirm a booking, and we accept your payment. It includes these Terms, any participation waivers, and our Privacy Policy.
2.2. These Terms outline your rights and obligations as well as those of The Hub Park. Please read them carefully, as they may affect your legal rights.
2.3. For safety reasons, we may amend or cancel bookings in certain situations detailed in sections 4 and 5.
3. Prices and Payment
3.1. All prices are stated in Kenyan Shillings (KES) and include applicable taxes. Prices may vary due to changes in operating costs or other factors. The price at the time of full payment confirms your booking.
3.2. Full payment is required at the time of booking. Payments may be made via credit card, mobile money (M-Pesa), debit card, or cash (on-site bookings only).
3.3. No booking is confirmed until full payment has been received.
4. Assumption of Risk
4.1. Indoor and outdoor activities inherently involve risks, including personal injury, loss, or even death. By participating, you voluntarily assume these risks.
4.2. We are not liable for delays, changes, or cancellations due to Force Majeure events (e.g., extreme weather, natural disasters, political unrest, government restrictions, pandemics, etc.). Participants will be informed and may reschedule their affected activities, subject to availability.
4.3. Participants must complete a Participation Waiver before engaging in Activities.
5. Cancellations and Refunds
5.1. Refunds for cancellations by Participants are subject to the following terms:
- More than 48 hours before the scheduled time.
- Less than 48 hours before the scheduled time: No refunds.
- No refunds for "No Shows" or participants arriving late.
5.2. Refunds for cancellations by The Hub Park are subject to the following terms:
- The Hub Park may cancel bookings due to unforeseen circumstances (e.g., safety concerns). Refunds will be issued for unused portions of your booking, excluding administrative fees.
6. Booking Amendments
6.1. Amendments to bookings are permitted up to 48 hours before your scheduled activity. Amendments are subject to availability.
6.2. Changes requested within 48 hours will incur a 100% amendment fee. Amended bookings are non-refundable.
7. AGE, WEIGHT, AND HEIGHT RESTRICTIONS
7.1. Age Restrictions: Participants must meet the minimum age requirement specified at each attraction.
7.2. Weight Restrictions: Each attraction may have specific minimum and maximum weight limits, which participants must meet for safety.
7.3. Height Restrictions: Each attraction may have specific minimum and maximum height limits, which participants must meet for safety.
8. HEALTH AND SAFETY
8.1. Participants with pre-existing health conditions (e.g., heart conditions, epilepsy, pregnancy) must consult a physician before participating. Participation in certain activities may be restricted based on health concerns.
8.2. We reserve the right to refuse participation to anyone under the influence of alcohol, drugs, or impairing medications.
8.3. Safety equipment, including helmets, harnesses, and other gear provided, must be used as instructed while participating in activities. Failure to comply may result in injury, disqualification from activities, or removal from the premises without a refund.
8.4. Participants are prohibited from bringing outside equipment, such as ropes, harnesses, helmets, or other gear, into the park. Only equipment provided by The Hub Park is permitted for use during activities.
9. DRESS CODE AND PERSONAL BELONGINGS
9.1. Participants must wear comfortable athletic clothing and closed-toe shoes. Loose or baggy clothing, dangling accessories, or inappropriate attire may restrict movement or pose a safety risk, and participation may be denied.
9.2. Personal items (e.g., phones, bags) are not permitted during the Activities.
9.3. The Hub Park is not responsible for lost or stolen items. Participants are encouraged to secure their belongings in the provided lockers.
10. FOOD AND BEVERAGE
10.1. Outside food and drinks are strictly prohibited except for water bottles. Designated areas within the park offer food and beverages for purchase.
10.2. Corporate and school groups are encouraged to order from the specially curated menus available. Orders for food must be placed at least 48 hours before the visit. Changes to meal requests must be made at least 24 hours in advance. Failure to do so may result in menu shortages or additional charges for wasted food.
11. SPECIAL REQUIREMENTS
11.1. Groups with children requiring special accommodations must notify us in advance to ensure the best possible experience.
11.2. All school groups must arrive, check-in, depart, and check out as a single group.
11.3. The Hub Park is committed to providing accessible attractions for participants with disabilities. Please notify park staff before any special requirements or requests for accommodations.
12. SUPERVISION AND CONDUCT
12.1. All Participants are required to queue respectfully, follow instructions from park staff, and conduct themselves in a manner that ensures the safety and enjoyment of others. Running, pushing, or other disruptive behaviors (e.g., bullying, swearing, causing disruption, or damaging property) may result in immediate ejection from the premises. No refunds will be provided in such cases.
12.2. Accompanying adults must remain with students at all times and are responsible for supervising their behavior. Unaccompanied students will not be permitted entry.
12.3. Additional teachers exceeding the required age ratio will be admitted at the student ticket rate.
13. PROHIBITED ITEMS
13.1. Prohibited items include but are not limited to weapons, illegal drugs, alcohol, and any items deemed hazardous by park staff. Any such items will be confiscated, and the participant may be denied entry or removed from the premises.
14. NO SMOKING
14.1. Smoking, including the use of e-cigarettes, is strictly prohibited in all areas of the park.
15. EMERGENCY PROTOCOLS
15.1. In case of emergencies, appropriate measures will be taken, such as contacting parents or arranging ambulance services. The Hub Park will not be liable for any associated expenses.
16. COMPLIANCE AND ETIQUETTE
16.1. All visitors must adhere to park regulations, observe posted signs, and follow staff instructions. Respectful behavior toward staff and fellow visitors is expected at all times.
17. ATTRACTIONS AVAILABILITY
17.1. Prices and timings are subject to change. Certain exhibits or areas may be closed due to safety or technical reasons.
18. EXCLUSIVITY AND CAPACITY
18.1. School bookings are non-exclusive and may be scheduled alongside other groups, adhering to health and safety standards. Exclusive facility access can be arranged upon request, subject to availability.
19. TRANSPORTATION AND ACCESS
19.1. Participants must arrange their own transportation to The Hub Park. Parking is available on-site but subject to availability.
19.2. Participants must arrive at least 30 minutes before their scheduled activity. Late arrivals will be considered as “No Shows.”
20. COMPLAINTS
20.1. Complaints during the activity should be reported immediately to our staff. For unresolved issues, submit a written complaint within 30 days of the activity.
20.2. Complaints submitted after 30 days may not be addressed.
21. PUBLICITY
21.1. By participating, you consent to being photographed or recorded for promotional purposes. You waive any rights to review or approve the use of such materials.
21.2. Participants are permitted to take photographs and videos for personal use only. Commercial photography or videography is prohibited without prior written consent from The Hub Park.
22. LANGUAGE
22.1. The primary language of communication at The Hub Park is English. Participants who require assistance in other languages are encouraged to bring a translator or translation applications.
23. LIABILITY DISCLAIMER
23.1. Participation is at your own risk. While we prioritize safety, The Hub Park is not liable for injuries, illnesses, or accidents resulting from inherent risks or participant negligence.
23.2. Our liability for damages is limited to the amount paid for the booking, except in cases of intentional misconduct or gross negligence.
24. AMENDMENTS TO TERMS
24.1. These Terms and Conditions are subject to change without prior notice.
25. PRIVACY
25.1. We collect and process personal data in accordance with our Privacy Policy, available on our website. By booking, you consent to this processing.
26. Governing Law and Jurisdiction
26.1. The laws of the Republic of Kenya govern these Terms. Disputes are subject to the exclusive jurisdiction of Kenyan courts.
26.2. Any purchase, dispute, or claim arising out of or in connection with this website or The Hub Park's activities shall be governed by and construed in accordance with the laws of the Republic of Kenya.
